Colorado Breeders Cup (CBC) 2008 Regulations (Click here for PDF version of regulations) Stallion Nomination (Stallion Owner/ Lessee) 1) Only purebred Arabian stallions with the following qualifications may be nominated to the Colorado Breeders Cup program: a) US National, Canadian National or Scottsdale Champion, Reserve Champion or Top Ten, or b) Regional Champion, Reserve Champion or Top Five, or c) Class A Champion or Reserve Champion, or d) Racing “Darley Nominee or Winner”, a Stakes Winner, received “Horse of the Year” or similar Award, has lifetime earnings of $5,000 plus, or e) Endurance Regional Top Ten in point accumulation, achieved 3,000 career miles, a winner of a 100 mile competition, received the “Jim Jones Top Stallion” or similar Award, or f) Have sired progeny with the above qualifications, or g) Achieved the International equivalent of the above qualifications. 2) First time nomination of a stallion may be accepted through 30 June of the participation year. Nomination forms may be downloaded from the CBC web site or requested from the CBC administrator. Re-nominations (stallions nominated the previous year) begin 1 July and continue through 31 December of any given year for the following participation year. (Example: nominations between 1 Jul, 2007 and 31 Dec, 2007, are for participation in 2008.) If the stallion is leased a copy of the lease agreement must accompany the nomination form. 3) The owner/lessee of each stallion whose breeding is sold will receive one (1) CBC Stallion Certificate (value equal to entry fee for CBC event). a) Certificate is redeemable one (1) time only for entry in any CBC sponsored competition event, at which time it will be surrendered. b) Certificate is transferable one time only by stallion owner/ lessee to any owner of the stallion’s progeny. CBC must be notified of such transfer by forwarding a copy of the certificate with transfer signature to CBC administration. c) Certificate may be used for any eligible progeny, five (5) years and younger, whether or not the stallion remains an eligible CBC nominated stallion, but it must be redeemed within a six (6) year period commencing the year it is issued. d) The certificate has no monetary refund value 4) All of the stallion’s progeny, five (5) years and younger, will be eligible to enter any CBC sponsored event during any year in which that stallion is considered eligible, by paying the regular event entry fee ($100). Eligible is defined by the participation year for which the breeding is sold. (Example: a breeding sold between 15 September, 2007 and 30 June, 2008 is sold for 2008 and provides eligibility for participation in 2008.) Stallion’s progeny foaled from a breeding purchased through the CBC will remain eligible to participate through the age of five (5) whether or not the stallion remains eligible. 5) In the event of a stallion’s death while eligible (i.e. the breeding has sold), all progeny, five (5) yrs and younger, will be eligible to enter CBC sponsored competition events in the year of death. If a stallion’s death occurs prior to fulfilling the breeding contract and paragraph 12 is applied, the stallion and his progeny become ineligible except as provided for in paragraph 3c, 4 and 11b. 6) If the stallion’s breeding remains unsold by 30 June of the participating year, the owner/lessee, may, at his/her option: a) Purchase the breeding at half the advertised fee, plus a $50 office fee by July 31of participation year. This will earn the stallion owner/lessee two (2) CBC certificates of entry, one as owner/lessee and one as the purchaser of the breeding, with all associated rights and restrictions. All progeny will remain eligible for CBC sponsored competition events. b) Re-nominate his/her stallion for the following year with no penalty but, except as provided for in paragraphs 3c, 4 and 11b, no progeny of that stallion will be eligible to participate that year. Stallion Breeding Purchase (Purebred Mare Owner/Lessee) 7) Stallion breeding purchase will commence 15 September for the following participation year and close 30 June of the participation year. (Example: commence 15 September, 2007 and close 30 June, 2008 for participation in 2008.) Purchase will be first come, first serve (the first form of payment to reach the CBC administrator). Nominated stallions MUST be posted on the CBC stallion webpage BEFORE they become available for sale. 8) The breeding is purchased from the list of available stallions for half (50%) of the advertised breeding fee, but not less than $500, plus a $50 administration fee for each breeding. The list and breeding purchase agreement can be found on the CBC web site, www.coloradobreederscup.com. The agreement may be downloaded or requested from CBC administration (paragraph 26). If the mare is leased a copy of the lease agreement must accompany the purchase agreement. Payment may be made by personal check or certified funds, payable to Colorado Breeder’s Cup, credit card (Visa/ Mastercard only) or cash. The fully completed purchase agreement, along with payment in full, may be mailed or emailed/faxed, if credit card information is supplied. In the event two (2) or more mailed purchase agreements for the same stallion arrive the same day, the one with the earliest postmark will be accepted. In the event two (2) or more electronically transmitted purchase agreements for the same stallion arrive the same day, the one with the earliest date/time stamp will be accepted. Electronically transmitted agreements received before 5 PM (Mountain Time) will be considered first come ahead of mailed agreements received the same day (5 PM Mountain Time). Purchase agreements received BEFORE a stallion is posted on the CBC stallion webpage will NOT be accepted and will be voided. 9) Each breeding purchased is done so for a specifically designated mare, as named on the purchase agreement. The named mare shall be subject to final approval by the stallion owner/lessee if so designated on the stallion’s nomination form. If the mare is not approved, another approved mare may be substituted, or if the breeding fee has been paid, another available nominated stallion may be selected (the breeding fee difference, if any, will be applied or refunded, as appropriate). In the event that the purchase agreement is received without a designated mare, the purchaser must designate the mare BEFORE Dec. 31 the year the foal is conceived. Failure to do so will automatically void the CBC Purchase Agreement, will cause both the purchase fee and the administration fee to be forfeited, and the resulting foal shall not be recognized as being a produced from a CBC purchased breeding. A stallion breeding purchase requiring mare approval must include the approved mare on the purchase agreement when submitted. 10) Once the purchase is accepted by CBC, both stallion owner and breeding purchaser will be notified of the transaction and provided contact information. Both parties shall abide by the terms of the breeding contract provided by the stallion owner except the stud fee which is covered by the CBC purchase agreement 11) Each breeding purchased earns one (1) CBC Foal Certificate. a) Certificate will be issued once CBC is notified and in receipt of CBC foaling report. The foaling report can be found on the Colorado Breeders Cup web site and is downloadable. It is the breeders responsibility to complete this report and forward it along with a copy of the foal's registration certificate to the CBC stallion administrator. This is the only means by which to ensure the foal's eligibility in the CBC program as a foal born from a CBC purchased breeding. b) Certificate is redeemable one (1) time only for initial entry in any sponsored CBC competition event through the foal’s fifth year of age, whether or not the stallion remains an eligible CBC nominated stallion (see definition paragraph 4). c) Certificate is not transferable to any other progeny but will accompany the foal if an ownership change occurs. d) The certificate has no monetary refund value. 12) In the event of the stallions death or otherwise inability to fulfill his breeding obligation after the breeding has been purchased, the purchaser will have the following options: a) A refund of the breeding fee (not to include administration fee) only in the participation year and only under extenuating circumstances, subject to BOD approval. Otherwise: b) Apply the fee paid to another available stallion for the same year or immediate subsequent year. If there is a difference in the breeding fee, that difference shall be paid if the substituted stallion's fee is greater. If the substituted stallion's fee is lower the substitution shall be considered equal. No additional administration fee is due for either circumstance.

In
the event of the mare’s death or otherwise inability to be bred, the mare
owner/lessee will have the a) Substitute another mare (may be subject to stallion owner approval). Substituted mare must be designated BEFORE Dec. 31 of the year the foal is conceived. Failure to do so will invoke the same provision of paragraph 9.
Colorado Breeders Cup Competition: 14) All progeny of eligible stallions, progeny foaled from a CBC breeding purchase and progeny represented by a Stallion Certificate, that are purebred and five (5) years old or younger, may participate in any CBC competition event. HA-AA foals born from a CBC purchased breeding prior to the 2008 participation year are grand-fathered into performance classes only through their fifth year of age. Close of entries shall be 12PM (noon) on the day prior to the scheduled day of the single event or scheduled first day of the designated show. There will be no late entries. Entry deadline will be considered met with the receipt of entry form and entry fee, but is not considered complete until all requirements are met and attachments received. Completed entries are required to compete and are due no later than one hour prior to the beginning of the scheduled session within which the event or class is listed. These requirements not withstanding, entry fees paid will not be refunded without a Veterinarian’s written statement of inability to compete. 15) CBC classes are offered for halter, sport horse in hand and performance at the designated Colorado Breeders Cup show. Halter and Sport Horse In Hand will be Amateur to Handle (ATH). Performance classes are not restricted to amateur riders and are open to junior horses 3 to 5 years of age. All show classes will be judged in accordance with CBC competition rules as specified in the respective shows' premium book for the following:
16) The Colorado Breeders Cup designated race, type and conditions to be determined on year by year basis by the CBC BOD to best accommodate the prospective entries. Races shall only be for for purebred three (3), four (4) and five (5) year olds. Distance and weights to be determined by the racing secretary. 17) The Colorado Breeders Cup endurance ride will be Limited Distance (25 miles) conducted in accordance with AERC rules and open to purebred four (4) and five (5) year olds. 18) Each horse to be entered in a CBC event must be registered with the American or Canadian Arabian Horse Registry. Weanlings may show with registration pending if pending status is verified by the respective Arabian Horse Registry in writing by the entry deadline. Any pay back money due will be issued once CBC is in receipt of the Registration Certificate and the foal’s eligibility is verified. 19) Exhibitors/owners must meet all of the requirements governing the respective show or event. CBC entrants shall be required to complete the CBC entry form in addition to any other forms that may be required by the hosting organization. Owners of CBC eligible progeny entered to compete in any CBC event/ class must be members of Colorado Arabian Breeders Alliance. A copy of the USEF membership card must accompany the CBC entry form to verify amateur status of the handler. Receipts, Expenditures, Paybacks: 20) CBC generates funding through breeding sales, competition (show, race and endurance) entry fees, and administration fees. 21) Breeding sales and entry fees are designated for competition payback with only the necessary amounts withheld for administrative and operating expenses (show/event expenses, ribbons/trophies, a breeding purchase payback reserve not to exceed the highest purchase fee, advertising, etc.) plus a designated percentage for community and charitable contributions. Administration fees provide additional funding for advertising, operating and administrative expenses. 22) Of the breeding sales money available for competition payback, five (5) percent will fund a “Top Stallion Breeder’s Award”. This award is presented to the owner/lessee on behalf of the stallion whose progeny earn the highest cumulative point total for all CBC events for that participating year. All entries placing one (1) through five (5) in each competition will earn one (1) point for each placing below them plus one (1) point for their placing, not to exceed five (5) total points per single event/ class. 23) Paybacks and ribbons are awarded to five (5) places, Champion, Reserve Champion, and Top Five. Trophies are awarded to Champion. a) All events that have entries will pay an equal amount of money to each Champion, Reserve Champion and Top Five respectively, regardless of the number of entries. b) Percentage of payback is as follows:
c) Lessees of a nominated stallion or participating progeny may receive paybacks and awards provided that a lease agreement which includes language directing such conditions is made available to the CBC administrator. In the absence of such an agreement the owner of the stallion or progeny will be the recipient. d) Paybacks will not be issued without a completed CBC entry form to include all required attachments. 24) The Colorado Breeders Cup Dam of Distinction (DOD) program is established to recognize those outstanding mares which produce multiple (different individuals) CBC champions. The three (3) award levels are Bronze, Silver and Gold and will be cumulative over the life of the mare. Bronze level DOD is a producer of two (2) individual champions. Silver level DOD is a producer of five (5) individual champions. Gold level DOD is a producer of ten (10) individual champions. Recognition is bestowed upon reaching each achievement level. Administration: 25) The Colorado Breeders Cup reserves the right to revise these regulations and resolve disputes and discrepancies as it deems appropriate. 26) Colorado Breeders Cup Administration
